FDA Contact information
Unfortunately the 888 number is closed on weekends but here's the number if anyone wants to call on Monday to verify that IQQU Acne Serum has been listed as not approved.
1-888-INFO-FDA (1-888-463-6332)
Here's the FDA's Facebook page:
http://www.facebook.com/FDA
Since Michelle is challenging people to call and verify I saw we do.

Re: FDA Contact information
Is selling non-FDA approved products illegal in the U.S.? I mean if they are shipped internationally, from a foreign destination, then do they also need an U.S. license to sell?
As far as lawsuit goes, many states have "long-arm jurisdiction" that allows an U.S. party to bring a lawsuit in an U.S. court even if the company is foreign domiciled.
I'd like to see the FDA code for international products before we call anything "illegal".

If a felony to commit fraud. She can sell the products with a disclaimer of "products are not FDA tested or approved" on the sunscreen and rice scrub but can't sell the acne serum at all since it's been listed as not safe and not effective.= = wrote:Is selling non-FDA approved products illegal in the U.S.? Side note: Anyone else care to issue a complaint can file a "suspected criminal activity" report with the FDA:

In your own words ask them if IQQU acne serum, sunscreen, sunscreen with spf 50 and the jasmine rice scrub are FDA approved and if the products are not approved then can they investigate Michelle Phan since she posts on her Facebook (include the links) that she's claiming the products are FDA approved and in one instance she was posting she'd change the packaging to reflect that.Bumble B wrote:I'll make a report! if we are getting legal here
I think the word you are looking for is "misrepresentation", or misleading advertising, rather than "fraud". And that is a civil matter, not criminal.

Re: FDA Contact information
Misrepresenting the product is like mascara commercials that claim the product makes your eyelashes longer and thicker and it's clear that the model is wearing false eyelashes. She's committing a fraud by claiming the product is FDA approved when in fact the product is NOT approved or was labeled as "NOT SAFE AND EFFECT.... NOT APPROVED". That's the difference in why what she's doing is fraud and not misrepresentation.bar exam wrote:I think the word you are looking for is "misrepresentation", or misleading advertising, rather than "fraud". I still don't understand how she can insist that her products are FDA-approved when they are clearly not. Does she really think she can get away with something like that?
Or maybe she just has no idea what "FDA-Approved" even means?

Well I reported her. Everyone should.
We also need everyone to report her to the FTC.

What is their official email address to report such fraudulent situations? I have been looking around and the Help Center is like a freaking maze. I reckon if more people email to them, the more they will look into it and take action.

Re: FDA Contact information
Thanks MeLu.
I've set a reminder in my phone to contact the number you provided for us.
I think if more people contacted the appropriate persons with regards to Michelle and her false statements and claims... ie, YouTube, the FDA, contacting Lancome/Loreal directly, FTC, charityfraud.org, we would see better results (one would hope).
I've always thought that no matter what happens in life, the truth will always come out, and goodness will always prevail. Sometime the truth needs a little assistance in getting there.
How many more times will Michelle contradict her words before enough is enough?

Ahahaha!
Wooooa nelly! I just read that Michelle Phail post on IQQU and the FDA...Man she could get in some serious trouble. How does one go about reporting someone to the FDA for fraud? I was reading through the post and I was just hoping someone would say "hey now, we need to fix this". The woman shouldn't be selling products that aren't even proven safe. I'm going to be mentioning this to Lancome soon she makes the company look trashy.
Let's see if she can sweet talk her way out of this one. Sorry sweetie, judges don't really react well to that scrunchy bunny nose thing...

LOL. I just love your last words, her cruchy nose will stay permanent with this big lie, it's not cute at all...and she challenged her fans to call USFDA for the facts while she knows what she said to them is bullshit!
Please help with what you can to stop her crime. MeLu gave the info to contact FDA to report, more ppl call and write to them will help to bring this issues to FDA's attention. If you call the number that post on the article and ask them about how to start your report. Please stay on the forum.

Re: FDA Contact information
I've left a brief message on the following FDA contact page just asking to confirm that the IQQU cosmetics line is FDA approved since claims are being made by the creator/spokesperson for the product, Michelle Phan.
I've also contacted the FDA via the toll free # that was provided in the original post of this message. It was a little time consuming to navigate until you got to a real person who will put you into the voicemail box of someone who will return your call. I ended up in Jennifer Shepherds voicemail and left a similar message to the one I left on the FDA website.
I looked up "IQQU" in their seach tab, and ZERO results came back, it doesn;t even recognize the product name which worries me.
Hopefully this will get investigated. If anything for the sake of making false claims that a product is FDA approved... that's no joke.

Re: FDA Contact information
I just called the FDA 888-723-3366. This after listening to the message prompt I hit ZERO to talk with a specialist.
I told the specialist I was calling about a skincare line claiming to be FDA approved but I was unable to find it on their website. She stopped me and told me that the FDA DOES NOT approve ANY skinare line. They do approve certain cosmetics, but skincare products CANNOT be FDA approved.
I didn't even bring up the product IQQU, she said it wouldn't matter who the manufacturer was. "Skincare products are not FDA approved."
I told her the founder of a product line is claiming their skincare is FDA approved. The specialist at the FDA responded "That would be impossible, and a false claim"
he specialist immediatly asked what state I was calling from and gave me another number to contact within my state. If you want to report that someone has made false claims via phone, you will have to call the 888 number I listed above and ask them for your local #. They were very nice and very helpful.
I've left another message with my local FDA contact, in the messae they suggest you have the packaging available for when an agent calls back. I'll provide them with the Michellepail site information.
If there are any other suggestion of what I should proivide them with...let me know!
